1. Agreement and scope
These Terms of Service ("Terms") explain the conditions for using the website foursyscloud.com and services offered under the name FourSys Cloud Hosting ("FourSys," "we," "our," or "us"). They apply to registered users, hosting subscribers, domain customers, and affiliates.
By ordering or using our services, you agree to the applicable Terms and the details shown for your selected plan and order. Our Privacy Policy explains how personal information is processed; it is a notice, not a replacement for any separate consent required by law.
If there is a conflict between a specific written service agreement accepted by both parties and these general Terms, the specific agreement applies to that service. Nothing in these Terms limits rights that cannot lawfully be waived under applicable law.
2. Accounts and access
You must provide accurate registration and contact information, maintain a valid email address, and keep your passwords, recovery methods, and administrator credentials secure. You are responsible for activities under your account except where responsibility arises from our own acts or failures under applicable law.
Please notify us promptly if you suspect unauthorized access. We may require additional verification before changing ownership details, restoring access, or disclosing account and financial information. You may not use another customer's account without authorization.
3. Hosting services and plan inclusions
FourSys provides shared or managed web hosting, website and domain management tools, DNS assistance, databases, SSL configuration, email hosting where included, and related support. Actual disk space, website limits, mailboxes, permitted software, and features depend on the plan shown at checkout and in the client dashboard.
Email mailboxes included with a hosting subscription are tied to that subscription, and are not separately charged unless a separate paid arrangement is expressly agreed. Software installations, server packages, and elevated access are available only where allowed by the subscribed plan and our operational security requirements. Requests for additional tools may be declined where they pose a stability or security risk.
Any public uptime percentage described as a target is an operational objective, not a guarantee of uninterrupted availability or an automatic service-credit agreement unless a separate written service-level agreement expressly provides one.
4. Prices, checkout, and payment
Hosting prices and amounts charged through our checkout are denominated in Philippine pesos (PHP). Any display in another currency is informational and may differ from the amount converted or charged by your bank or card provider. The price, duration, applicable discounts, and included services are presented before order confirmation.
Payments may be handled through third-party payment processors such as PayMongo. A submitted order does not necessarily mean payment succeeded. Hosting and domain provisioning can depend on confirmed payment, technical checks, registrar responses, and fraud prevention reviews.
Bank conversion charges, issuer fees, and government taxes or charges that are legally applicable may be separate from the advertised hosting price where clearly disclosed during checkout.
5. Renewal, expiry, and service suspension
Hosting services have the subscription period selected for the order. Please check the expiry date in your dashboard and renew before expiration. We may send expiration reminders, but delivery cannot be guaranteed.
If an account expires or a renewal is not completed, associated website access, email functionality, and related services may be restricted, suspended, or eventually removed after applicable notices and retention procedures. Customers should export their websites, mail, databases, and other content before expiry or cancellation.
We may temporarily limit or suspend access in response to abuse, nonpayment, security incidents, legal requirements, or threats to the shared hosting environment. When practical and appropriate, we will notify you and provide a way to address the issue.
6. Domain registration, DNS, and temporary addresses
Domain availability is not guaranteed until the applicable registrar or registry confirms registration. Registrations and renewals are subject to the rules, verification requirements, availability, pricing, dispute procedures, and policies of the relevant registry and registrar. Your contact details may need to be sent to those providers to carry out your order.
You are responsible for supplying accurate domain registrant information and completing required verification requests. Domain registration periods, renewal fees, transfers, and restoration opportunities are not necessarily the same as those of the hosting plan. A domain may be suspended or lost if required verification or renewal is not completed.
Domain purchases are non-refundable once successfully processed. This includes domain registrations, renewals, and transfers completed by the registrar or registry. Please confirm the spelling, extension, registration term, and registrant details before payment. Exceptions apply where the domain service was not delivered, where an error attributable to FourSys requires a remedy, or where a refund is required by applicable law.
Free or temporary FourSys hostnames are provided for convenience and remain managed by FourSys. They do not confer ownership of the parent domain. We may withdraw or change a temporary hostname when required for security, operations, or policy compliance.
7. Acceptable use
You may use our services only for lawful activities. You must not use a hosting account, DNS zone, mailbox, or website to:
- Distribute malware, phishing pages, ransomware, or other harmful software.
- Send unsolicited bulk messages, run deceptive campaigns, or abuse mail reputation.
- Host unlawful content, infringe intellectual property rights, or violate another person's privacy.
- Attempt unauthorized access, scanning, denial-of-service activity, or interference with other customers.
- Operate prohibited mining workloads or resource-intensive processes that materially harm shared infrastructure.
- Resell or transfer access in ways that violate the plan or a separate service agreement.
Reasonable resource-management and security limits may apply to CPU, memory, storage, processes, email sending, or other system use. We may investigate abuse reports and take proportionate action, including temporarily suspending affected services when necessary to protect customers or comply with law.
8. Security, email, and backups
We maintain security controls for the hosting platform, but no internet-connected service can be guaranteed free from vulnerabilities, interruptions, or data loss. Customers remain responsible for application updates, strong passwords, appropriate access controls, safe handling of personal information on their websites, and their own independent copies of important content.
If your plan advertises scheduled backups, those backups are an additional recovery measure, not a substitute for your own backups. Availability and restorability can be affected by storage failures, corruption, elapsed retention windows, or incident scope. Contact support promptly if recovery assistance is needed.
9. Affiliate vouchers, referrals, and payouts
Affiliate membership is subject to application approval and continuing compliance. Approved affiliates can maintain up to three nondeleted voucher codes at a time. Affiliate offers apply only to eligible customers making their first hosting purchase; self-referrals and certain existing customers are not eligible.
The customer discount may be set from 5% to 10%. For eligible first hosting purchases, the affiliate's commission percentage is 20% minus the customer discount percentage, calculated on the discounted hosting amount actually paid, excluding domain charges. Eligible hosting renewals may earn 5% commission without a renewal discount.
Commissions can be delayed for a 30-day review period and adjusted, held, or reversed in connection with refunds, disputes, chargebacks, fraud, or other ineligible orders. A minimum available balance of ₱500 is required to request a withdrawal. Payouts are reviewed and transferred manually to the affiliate's saved payout destination.
Affiliates must not make misleading earnings claims, impersonate FourSys, misuse our brand, engage in prohibited spam, or offer unauthorized promises to customers. FourSys may suspend or terminate participation for material misuse, while retaining records needed for legitimate commission or dispute reconciliation.
10. Cancellations and refund requests
You may request service cancellation through the available dashboard functions or by contacting [email protected]. Cancellation does not automatically cancel unrelated domain registrations or third-party commitments. Export any required data before requesting irreversible deletion.
Hosting cancellation or refund requests are assessed according to the service involved, its activation and provisioning status, applicable third-party charges, and mandatory consumer rights. Cancellation of hosting does not cancel or automatically refund a separately registered domain.
Domain registration, renewal, and transfer fees are non-refundable after successful processing by the registrar or registry. This applies to requests based on a change of mind, an unused domain, an incorrectly chosen domain name or extension, or early cancellation. A failed or uncompleted registration, renewal, or transfer will be reviewed for refund or correction. This policy does not limit a consumer's right to a remedy for a failure to deliver the purchased service, errors attributable to FourSys, or any other rights under applicable law. Contact support with the order number and relevant details.
11. Content ownership and responsibility
You retain rights to website content, applications, and information you lawfully upload or create. You give FourSys permission to process and store that content only as needed to operate your purchased services, perform requested technical support, comply with law, or address security incidents.
We are responsible for providing the services with reasonable care, subject to the selected plan and applicable law. Neither party is responsible for delays caused by events genuinely outside reasonable control, but this does not excuse obligations that the law does not allow a provider to exclude.
If you process other people's personal data through a hosted website, you are responsible for your own privacy notices and lawful processing decisions, and FourSys may act as a service provider processing that data on your instructions. See our Privacy Policy.
12. Changes, governing law, and contact
We may update these Terms as our services, providers, or legal obligations change. Material changes affecting existing customers will be communicated through reasonable channels when appropriate. Changes do not remove rights or remedies already provided by mandatory law.
These Terms are intended to be interpreted under applicable Philippine law, without overriding any consumer or privacy protections that otherwise apply. For questions, account concerns, or disputes, email [email protected] or use our contact page.
If your order includes a domain, remember that the registry's and registrar's policies may impose additional verification, transfer, and renewal conditions.
